    WHAT IS THE TCPA?

    The TCPA is a federal law enacted in 1991. The Federal Communications Commission, or the FCC, is charged with enforcing the TCPA and promulgating rules. Among other things, the TCPA allowes individuals and entities to file lawsuits and collection damages for receiving certain unsoliciated pre-recorded or automated dialed telephone calls or textmessages, or faxes.


    DOES THE TCPA EXEMPT POLICICAL COMPAIGN ADVERTISING?

    Contrary to the belief of many, the TCPA does not necessarily except political compaign-related calls under the FCC Enforcement Advisory. The TCPA provides for damages ranging from $500 up to $1500 per unsolicited call/message. 


    DOES THE TCPA EXEMPT DEBT COLLECTION?

    With certain exceptions and federal debt, the TCPA does not exempt debt collection call on prerecorded or ATDS calls to a cell phones or prerecorded to residential lines. 

    ARE YOU RECEIVING UNSOLICITED ROBOCALLS OR TEXTMESSAGES?

    If you receive more than five calls or textmessages a day on your cell phone, chances are you receive robocalls or textmessages. If you answer a call and nobody is there, that's another sign of an autodialer. Or if you receive voicemails with a prerecorded message or part of the message includes a computerized voice, you might be receiving robocalls.
